News: Comair vs Blue Grass Airport, Who Is To Blame?

Regional airline Comair has sued the federal government and the Blue Grass Airport in Lexington KY, in connection with the fatal crash at the airport last year. The crash claimed all 47 passengers and two of the three crew on board. The suit also lists individual airport and FAA employees. The NTSB recently blamed the accident on pilot error (see article below).
This lawsuit makes me wonder, who is to blame (the airport or the pilots)?
